General Terms and Conditions (GTC) apply to contracts concluded between the language school Sprachtraum and third parties (hereinafter referred to as "customer" and/or "student") regarding the provision of services in the field of language instruction.

Registration and Payment:
Course registration can be done online at www.sprachtraum.at, via email at info@sprachtraum.at, or in person. Each course registration constitutes a binding contract and obligates payment of the course fee.
 The course fee must be transferred immediately after registration.

Available course places are allocated in the order of receipt of the course fee. Course participation is only possible after prior payment. Course booking is confirmed via email. Simultaneously, you will receive the payment confirmation. Due to the small business regulation according to Par. 6 Abs. 1 Z 27 UStG 1994, participant fees do not include value-added tax (VAT).

Installment payments can only be agreed upon before the start of the event. Unless expressly agreed upon, the costs for catering or accommodation are not included in the event fee.

 

Venue / Place of Performance:
Events take place at various locations. The address is always indicated in the course description.

If events are held at a different location upon the customer's request, they are obligated to provide the necessary infrastructure and technical equipment.

 

Teaching Unit:

The duration of the events is indicated in "teaching units" or "TU". Generally, one teaching unit lasts for 45 minutes.

 

Scripts, Study Materials:

For many events, participants are provided with scripts or study materials, which, unless otherwise stated, are generally included in the event fee and distributed at the beginning of the event. The materials provided by the language school may not be duplicated, distributed, kept for sale, made accessible to the public, or put into circulation.

 

Image, Video, and Audio Recordings:
Making image, video, and audio recordings of the learning material, lecture, or individuals during the events is strictly prohibited.

 

Confirmation of Participation:
Certificates of attendance for the event will be issued free of charge if the participant has attended at least 75% of the respective event.

 

Changes in Course Program / Event Cancellation:
If the minimum number of participants is not reached, a course may be shortened or canceled. Already paid course fees will be fully refunded in the event of course cancellation. In case of illness or other impediments of the language trainer, the corresponding course unit may, at the discretion or possibility of the language school, be conducted by a substitute trainer or rescheduled to an alternative date. There shall be no compensation for expenses incurred or other claims against the language school.

 

Right of Withdrawal:
For distance contracts (initial registration online or via email), the customer has the right to withdraw from the contract within fourteen calendar days without stating reasons. This right of withdrawal does not apply to courses that start within these 14 working days from booking.

 

The withdrawal period is fourteen days from the day the contract is concluded. To exercise the right of withdrawal, the customer must inform the language school by means of a clear written statement regarding the withdrawal. This can be done, for example, by sending a letter by post or by email.

Sending the notification before the deadline is sufficient to comply with the withdrawal period. Participation in a course unit of the course extinguishes the right of withdrawal.

 

Consequences of Withdrawal:
If the customer withdraws from the contract, the language school must promptly and no later than within fourteen days from the receipt of the notice of withdrawal, refund all payments received in respect of the contract. No charges will be levied for the repayment.

 

Cancellation Conditions:
Unless the previous provision regarding the statutory right of withdrawal applies, course bookings can be canceled as follows:

  • Up to 3 weeks before the start of the course: free of charge

  • Up to 7 calendar days before the start of the course: 50% of the course fee

  • For later cancellations: 100% of the course fee

Cancellations are valid only upon confirmation by the language school.

A postponement of the first course unit due to illness or other impediments of the language trainer does not extend the cancellation period. For delayed commencement or earlier withdrawal as well as missed course units, no reduction or refund will be made. Missed course units cannot be made up for.

 

Timeframe – Individual Training:
A timeframe is established for individual training. This timeframe is binding, and upon agreement with the language school, it can be extended by a maximum of four weeks. Unused teaching units within this timeframe expire, and no refund is possible.

 

Appointment Cancellation – Individual Training:
Agreed appointments can be canceled in writing or by phone up to 24 hours in advance. For later cancellations, the hours will be considered attended and will be invoiced.

 

Data Protection:
By registering/course booking, the customer agrees to the GTC and the Privacy Policy and permits the electronic processing of the personal data provided by them by the language school. The data is stored solely for internal processing for the purpose of contract fulfillment and processing. Without the customer's consent, their data will not be disclosed to third parties, except to the tax advisor to fulfill tax obligations.

Participants agree that their names, email addresses, or phone numbers may be shared within the respective course group, allowing participants to support each other in learning and practicing if they wish, or exchange information about the content of a missed class, for example. Furthermore, the Privacy Policy applies.

 

Disclaimer:
The language school assumes no liability for damages to or loss of personal belongings. No guarantee is given for individual learning success. No liability claims against the language school can arise from the application of knowledge acquired in the language school.

 

Special Regulations Concerning COVID-19:
Participants in face-to-face courses are obliged to comply with the legal regulations for the protection of health related to COVID-19 (social distancing and hygiene rules) in the premises of the language school. Participants with symptoms such as coughing, sneezing, or similar that may promote infection may not attend the course unit.

In the event of a renewed official closure of the language school related to COVID-19 or official requirements that make it impossible to conduct the course in the premises of the language school, the affected units of the course will take place as interactive live video group courses via video conference online.

There is no entitlement to a full or partial refund of the course fee.

Legal Form and Jurisdiction:
The language school is a sole proprietorship based in Zell am See. The competent court in Zell am See is agreed upon as the place of jurisdiction for any disputes arising from these GTC.

For consumers within the meaning of the KSchG, the statutory provisions apply.
